Terms of Service

By accessing or using Magic Lap ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all users, including free trial users and paid subscribers.

Magic Lap is a unified advertising analytics dashboard that aggregates data from multiple advertising platforms via Windsor.ai and displays performance metrics, insights, and reports in a single interface.

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account and password.
• You must notify us immediately of any unauthorized access to your account.
• One account per person. Sharing accounts is not permitted.
• You must be at least 18 years old to use the Service.

New accounts receive a free trial period as specified during signup. The trial includes full access to all features. At the end of the trial, you must subscribe to a paid plan to continue using the Service. Trial periods are non-renewable and limited to one per workspace.

• Payment method: subscriptions are paid via PayPal. After completing a PayPal payment, you must submit your Transaction ID through the billing page for manual verification by our team.
• Activation: access is granted after payment verification, typically within 24 hours of submission.
• Billing period: subscriptions are billed on the period you select (monthly or annual). You are responsible for renewing before the expiry date.
• No automatic renewals: we do not automatically charge your payment method. You must actively renew each billing period.
• Refunds: all payments are non-refundable unless required by applicable law.
• Price changes: we will provide at least 30 days notice before changing prices.

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use automated tools to scrape or harvest data from the Service at scale.
• Share your account credentials with others.
• Use the Service to transmit viruses, malware, or other harmful code.
• Interfere with or disrupt the integrity or performance of the Service.

The Service connects to third-party platforms (Meta, Google, TikTok, Windsor.ai, etc.) using credentials you provide. By using these integrations, you confirm that:

• You have the right to access the advertising accounts you connect.
• Your use complies with each platform's terms of service.
• We are not responsible for third-party platform availability, accuracy of data, or changes to their APIs.

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

You retain ownership of all advertising data and campaign data in your workspace. We process this data solely to provide the Service.

The Service, including its design, code, and content, is owned by Magic Lap and protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service.

You grant us a limited license to display and process your data solely to provide the Service.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

We are not responsible for the accuracy of advertising data provided by third-party platforms via Windsor.ai. Always verify critical metrics directly in your ad platforms.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGIC LAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.

We may suspend or terminate your account if you violate these Terms, fail to pay for your subscription, or engage in conduct that we determine is harmful to other users or the Service.

You may close your account at any time by contacting support. Upon termination, your access to the Service ends immediately. We will delete your data within 30 days.

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

These Terms are governed by applicable law. Any disputes shall be resolved through good-faith negotiation first, followed by binding arbitration if necessary.
